The Army
Corp of Engineers (USACE) oversees the protection and management of jurisdictional "waters of the U.S.”
including navigable streams, their tributaries and connected wetlands. This can also include ponds, impoundments, industrial
basins and lakes provided there is a hydrological connection.
The
laws, regulations and technical applications can be a complicated process. Therefore,
we strongly recommend that prior to construction, filling, or impacting wetlands, open waters or streams you seek out the
services of a qualified wetland and stream consultant.
The
ramifications of impacting "waters of the U.S."
without proper authorization can result in numerous negative impacts to the individual, corporation and project. These
impacts can be in the form of a notice of violation, cease and desist order, fines, civil and/or criminal penalties.
